Domestic battery is a serious crime that occurs when an individual physically strikes another person and causes bodily harm. It is always prudent to consult an attorney if you have been accused or false charges have been brought against you. Our team of lawyers at Heather Harris Law has the ability to investigate your case and aggressively defend you in a court of law.

Battery and aggravated battery or felony battery under Florida laws

Often, charges of battery abuse are falsely brought against a partner during the process of separation or divorce. Some partners use this to their advantage in an attempt to procure a restraining order in a divorce case. Florida courts do not take cases of battery or aggravated battery lightly, with harsh punishments including incarceration and fines imposed in case of a conviction. Under Florida Statute section 784.03, for charges of battery the prosecutor is required to prove beyond reasonable doubt that the defendant intentionally used physical force against the will of the victim and intended to cause bodily harm. Aggravated battery or felony battery, under Florida Statutes Section 784.045 and 784.041, requires that the prosecutor provide proof and evidence that the defendant knowingly caused bodily harm to the alleged victim, or used a deadly weapon in a manner that caused bodily harm or death.  Therefore, if you have been accused under any section it is prudent to contact a lawyer as soon as possible.
